Gift Card – General Terms and Conditions

§1 Scope and Issuer

(1) The following terms and conditions apply to all gift cards (hereinafter “Gift Card”) issued by Laylaundyom UG (hereinafter “Lumond”).

(2) By purchasing, accepting or redeeming a Gift Card, the holder agrees to these terms and conditions.

§2 Available Formats and Purchase

(2) The Gift Card can be purchased in various denominations. The available denominations can be found in the online shop at www.lumond.com.

(3) The Gift Card can be paid for using any payment method accepted in the online shop. However, a Gift Card cannot be used to purchase another Gift Card.

§3 Validity

(1) The Gift Card is valid indefinitely from the date of purchase, unless a different expiry date is indicated on the Gift Card.

(2) The Gift Card can only be redeemed in the online shop at www.lumond.com.

(3) The Gift Card can be used for all products available in the online shop.

§4 Redemption and Remaining Balance

(1) The Gift Card may be used by the holder as many times as desired until the balance has been fully used up.

(2) The remaining balance of the Gift Card equals the difference between the original balance and the amount already used for purchases.

(3) If the purchase amount exceeds the remaining balance, the difference may be paid using any payment method accepted in the online shop.

(4) Any remaining balance cannot be exchanged for cash or transferred to a bank account.

(5) The current remaining balance can be viewed at any time during the checkout process at www.lumond.com.

§5 Return of the Gift Card

(1) For digitally purchased Gift Cards (E-Gift Cards), a statutory right of withdrawal of 14 days from the date of purchase applies, provided the Gift Card has not yet been redeemed.

(2) Refunds will be issued in the original form of payment. The order confirmation must be presented for the return.

(3) Partially redeemed Gift Cards cannot be returned.

§6 Return of Goods Purchased with a Gift Card

(1) If goods that were paid for in whole or in part with a Gift Card are returned, the Gift Card portion will be refunded as a new Gift Card. The Gift Card will be sent by email to the email address used for the order.

(2) For the non-Gift Card portion, the standard return conditions as set out in our General Terms and Conditions apply.

§7 Responsibility and Liability

(1) The Gift Card is a bearer instrument. The respective holder is solely responsible for the use and safekeeping of the Gift Card (including the Gift Card code).

(2) Lumond shall not provide replacement in the event of loss, theft or unauthorised use of the Gift Card. It is recommended to keep the Gift Card code confidential and store it securely.

(3) Lumond assumes no liability for non-receipt or delayed receipt of an E-Gift Card if the cause lies outside the responsibility of Lumond, in particular in the case of:

§8 Misuse and Invalidity

(1) Gift Cards that have been obtained unlawfully or tampered with are invalid and can neither be redeemed nor refunded.

(2) Lumond reserves the right to block Gift Cards where there is a suspicion of fraud or misuse.

(3) Without prior written consent from Lumond, Gift Cards may not be used for commercial advertising or marketing purposes of third parties, nor may they be resold.

§9 Data Protection

In connection with the purchase and use of Gift Cards, personal data (e.g. email address of the purchaser and the recipient) is processed. For details on data processing, please refer to our Privacy Policy.

§10 Applicable Law and Jurisdiction

(1) The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) For consumers, this choice of law shall only apply insofar as the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence is not withdrawn.

(3) If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be our place of business in Berlin.

§11 Severability Clause

Should any provision of these terms and conditions be or become wholly or partially invalid, the validity of the remaining provisions shall not be affected.
